Welcome to Fintify, an app developed by Appnova Enterprises Limited Company that provides automated trading chart analysis. By taking a picture of one or more trading charts, you receive AI-generated insights, a potential game plan, and other analytical commentary (collectively, the “Analysis”). These Terms of Use (“Terms”) govern your access to and use of Fintify, including our app, website, and other tools (collectively, the “Service” or “Services”). By accessing or using Fintify, you agree to these Terms, our Privacy Policy, and any other applicable policies. If you do not agree to these Terms, you may not use Fintify.

Acknowledgment

This End-User License Agreement (EULA) is between you and Appnova Enterprises Limited Company. Appnova Enterprises Limited Company is solely responsible for the content, maintenance, and support of the app, as well as for any claims related to the app. No other party, including Apple, has any obligations under this EULA.

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance of the terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Scope of License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use Fintify for personal, non-commercial purposes on any Apple-branded devices that you own or control, as permitted by Apple’s Usage Rules. This license does not grant you ownership of the app or any related intellectual property.

Maintenance and Support

Appnova Enterprises Limited Company is solely responsible for providing maintenance and support for Fintify. Apple has no obligation to furnish any maintenance or support services for the app.

No Financial Advice

The Analysis provided by Fintify is strictly for informational purposes. It does not constitute financial, investment, or trading advice. The Service may produce predictions, suggestions, or game plans based on AI algorithms, but these are speculative in nature. You should always conduct your own independent research, consult with licensed professionals, and exercise due diligence before making any financial decisions.

We are not responsible for the correctness, accuracy, or reliability of any content, insights, or predictions generated by Fintify. All actions you take based on the Analysis are made independently by you, and we assume no liability for your decisions.

Warranty Disclaimer

In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). To the maximum extent permitted by law, Apple will have no other warranty obligations with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty are the sole responsibility of Appnova Enterprises Limited Company.

THE ANALYSIS, PREDICTIONS, AND ANY OTHER INFORMATION PROVIDED BY FINTIFY ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Product Claims

Appnova Enterprises Limited Company is responsible for addressing any claims by you or any third party relating to the app, including but not limited to:

• Product liability claims
• Any claim that the app fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection or similar legislation

Intellectual Property Rights

In the event of any third-party claim that the app infringes on a third party’s intellectual property rights, Appnova Enterprises Limited Company is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Legal Compliance

By using Fintify, you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or has been designated by the U.S. Government as a “terrorist-supporting” country and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms of Agreement

You agree to comply with applicable third-party terms of agreement when using Fintify (e.g., your wireless data service agreement when using a VoIP application).

Modification of Terms

We reserve the right to modify these Terms at any time. Notice of changes will be provided via the app or other communication methods. Continued use of the app following any changes constitutes acceptance of the revised Terms.

Age and Legal Capacity

To use Fintify, you must:

• Be at least 13 years old.
• Have the legal capacity to enter into contracts under United Kingdom law. If you are under the age of 18 and reside in the European Economic Area (EEA), you may only use Fintify with parental consent as required by your country’s laws.

Your Responsibility for Your Account

You are solely responsible for all activities conducted under your Fintify account. Protect your account and notify us immediately if you suspect unauthorized access or any security breach. We reserve the right to restrict or terminate access for any violations of these Terms.

Using Fintify Responsibly

You agree to use Fintify only for lawful purposes. Activities that violate applicable laws or regulations or these Terms may lead to account suspension, termination, or legal action.

To ensure fair use and protect our Services from abuse, each user is subject to an underlying usage quota. Exceeding this quota may result in temporary restrictions or termination of access to the Services. We retain the right to modify these quotas and associated policies at any time and at our sole discretion.

Complaints and Content Violations

If you believe content on Fintify violates your rights or these Terms, contact us immediately. We will review complaints and take appropriate action as necessary.

Termination

We reserve the right to terminate or suspend your access to Fintify at any time and for any reason, with or without notice. Serious violations of these Terms may result in immediate suspension without prior notification.

Subscriptions

Automatic Renewal and Cancellation

Fintify offers a weekly subscription. Subscriptions automatically renew until canceled, and charges will continue to apply unless canceled at least 24 hours before the current billing period ends.

Subscriptions can be managed or canceled through your app store account settings. Upon cancellation, access to subscription features will end after the billing period.

Payments and Refunds

Subscription payments are processed via your app store provider (e.g., Apple). Refund requests must be made through the app store provider as Appnova Enterprises Limited Company does not process refunds directly.

Changes to Subscriptions

We reserve the right to modify subscription features, terms, or pricing at any time.

Data Privacy and Use

Appnova Enterprises Limited Company collects and uses technical data to improve its products and services. Personal data is processed in compliance with applicable laws, including GDPR. Please refer to our Privacy Policy for more details.

Dispute Resolution

Any disputes arising from these Terms will be resolved through arbitration or mediation in accordance with the governing law specified below.

Indemnification

You agree to indemnify and hold harmless Appnova Enterprises Limited Company and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your misuse of the app or violation of these Terms.

Termination

We reserve the right to terminate or suspend your access to Fintify at any time and for any reason, with or without notice. Serious violations of these Terms may result in immediate suspension.

Jurisdiction and Governing Law

These Terms are governed by the laws of United Kingdom. Any disputes will be subject to the jurisdiction of courts in United Kingdom unless otherwise specified by mandatory applicable law.

General Provisions

Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights or obligations without restriction.

Severability

If any provision is deemed unenforceable, the remaining provisions remain valid.

No Waiver

Failure to enforce any provision does not waive that provision or others.
